Kenya’s intellectual property (IP) landscape has matured into a robust framework that aligns with international standards such as WIPO, TRIPS, and ARIPO. The country has enacted comprehensive laws covering patents, trademarks, copyrights, industrial designs, and trade secrets, backed by specialized institutions like KIPI, KECOBO, and ACA. These structures have enabled the growth of successful public-private partnerships (PPPs), facilitated technology transfer, and supported the commercialization of innovations across diverse sectors, particularly agriculture, health, and ICT.

Despite this strong foundation, challenges persist. Enforcement of IP laws remains weak, with counterfeiting and piracy posing significant threats to innovators and investors. Lengthy legal proceedings further undermine the effectiveness of the system, while limited public awareness continues to hinder full utilization of IP protections by SMEs, creators, and local innovators.

The report emphasizes the need for Kenya to strengthen enforcement mechanisms, expand public awareness campaigns, and streamline dispute resolution processes to ensure faster and more reliable outcomes. By addressing these challenges and continuing to promote PPPs and technology transfer, Kenya can maximize the role of IP in driving economic growth, fostering innovation, and enhancing its competitiveness in global markets.
